These Terms of Service (“Terms”) govern your use of disneytrucking.com (the “Site”), operated by T. Disney Trucking & Grading, Inc. (“T. Disney Trucking,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms govern use of the Site only. Hauling, materials, and related services are provided under separate written agreements, purchase orders, work orders, or credit agreements. If anything in these Terms conflicts with a signed agreement between you and T. Disney Trucking, the signed agreement controls.
You may use the Site for lawful purposes related to evaluating, requesting, or managing our services. You agree not to:
- Use the Site in violation of any applicable law or regulation
- Attempt to gain unauthorized access to the Site, its servers, or any connected system
- Introduce malware, or interfere with or disrupt the Site or its infrastructure
- Use automated means to scrape, harvest, or collect information from the Site without our written permission
- Submit false, misleading, or fraudulent information through any form on the Site
- Use the Site to transmit unsolicited commercial messages
2. Quotes, Requests, and Applications
Information you submit through the Site — including quote requests, hauler inquiries, employment inquiries, and credit applications — is an inquiry only. It does not create a contract, reserve capacity, or obligate either party. Pricing, availability, and scheduling quoted through the Site are estimates subject to confirmation, material availability, site conditions, fuel costs, and a written agreement.
You represent that information you submit is accurate and that you are authorized to submit it on behalf of any business you identify.
3. Independent Contractors
T. Disney Trucking coordinates hauling through a network of independent owner-operators and hauling companies. Each hauler operates its own business, holds its own operating authority and insurance, and is responsible for its own compliance with federal and state transportation regulations. Nothing on the Site creates an employment, agency, partnership, or joint venture relationship between T. Disney Trucking and any hauler, applicant, or Site visitor.
The Site and its contents — including text, graphics, logos, photographs, page layouts, and the T. Disney Trucking name and marks — are owned by T. Disney Trucking or its licensors and are protected by United States copyright and trademark law. You may view and print pages for your own business use in evaluating our services. You may not otherwise reproduce, republish, distribute, or create derivative works from Site content without our prior written permission.
5. Third-Party Links and Services
The Site may link to third-party websites and uses third-party services such as Google reCAPTCHA. We do not control third-party sites and are not responsible for their content, availability, or privacy practices. Links are provided for convenience and do not imply endorsement.
6. Disclaimer of Warranties
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that content is complete, current, or accurate.
Informational content on the Site — including blog articles discussing regulations, specifications, permitting, and industry practices — is general information, not legal, engineering, or compliance advice. Regulations change. Verify current requirements with the applicable agency and consult qualified professionals before relying on any statement for a specific project.
7. Limitation of Liability
To the fullest extent permitted by law, T. Disney Trucking and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or relating to your use of the Site, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited under applicable law. This section applies to use of the Site and does not modify liability provisions of any separate signed services agreement.
You agree to indemnify and hold harmless T. Disney Trucking and its officers, employees, and agents from claims, damages, losses, and reasonable attorneys’ fees arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
Our Privacy Policy explains what information we collect and how we use it, and is incorporated into these Terms. Our SMS messaging program is governed by our SMS Terms & Conditions.
10. Changes to the Site and These Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms; the revised version will be posted here with an updated “Last updated” date and takes effect when posted. Your continued use of the Site after changes are posted constitutes acceptance.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any action arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the jurisdiction of those courts.
12. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy and SMS Terms, constitute the entire agreement between you and T. Disney Trucking regarding use of the Site.
